30-year-old Selvihan Özdemir, who lives in Antalya's Kumluca district, started a legal battle, claiming that her left foot was accidentally operated on at the private hospital where she applied due to her right knee injury. Explaining the process she went through, the young woman said, "My right knee was injured, but when I came out of the surgery, I saw that my left foot, which had no problems, had been operated on."

Selvihan Özdemir (30), who stated that she injured her right knee while doing sports in January 2024, said that she was first sent to Kumluca State Hospital and then to Antalya Training and Research Hospital. Stating that he was given an MRI appointment 3 months later, Özdemir explained that he applied to private hospitals because he did not want to wait. Stating that he went to a private hospital in Kumluca upon the recommendation of a friend, Özdemir said, "The doctor told me that he could perform the surgery. He explained that he was a student of the professor at Antalya Training and Research Hospital and that they were in constant contact. He said that I lived here and that I could reach him day and night if there was a problem. These words gave me confidence and I decided to have the surgery."

"After the surgery, I saw that my left foot was operated on."

Explaining what he experienced on the day of the surgery, Özdemir said, "The doctor came to my room in the morning and marked my left foot. Since he told me that a bone and ligament transplant would be performed, I thought tissue would be taken from my left foot. During the surgery, I woke up several times due to the pain in my left leg. Later, when I went to the ward, I realized that my left foot was very painful. When I had my brother look at it, we saw that there was no procedure on my right foot and that my left foot was operated on. I was in great shock at that moment."

Stating that they called the doctor after realizing the situation, Özdemir said, "The doctor first said that he had done nothing wrong. I told him that I would know best which foot was injured. When he came to the hospital, he did not want to accept it at first. Then he admitted that he had performed the wrong surgery and signed a report saying that he would cover all the treatment expenses."

"I had surgery on both my feet within a month"

Stating that he was referred to Antalya Training and Research Hospital after the wrong surgery, Özdemir said, "About 15 days later, I had surgery on my right foot, which was really injured. I had surgery on both feet within a month. I was bedridden for a long time. My mother and father had to take care of me. I lost my job. I also had a very difficult time psychologically."

Claiming that he also had health problems in his left foot, which was operated incorrectly, Özdemir said, "Currently, I have problems in both my feet. I cannot run or walk fast. My feet swell when I stand for a long time or in cold weather. I have difficulty standing up when I sit for a long time. I cannot kneel down, I cannot use my knees as I want."

He filed a compensation lawsuit

The young woman, who started a legal fight after all these events, stated that she fought for 2 years, but the prosecutor's office decided not to prosecute due to missing documents. Thereupon, Selvihan noted that she filed a compensation lawsuit against the doctor and other responsible parties after receiving the forensic report from Konya proving that it was due to the wrong surgery.

Özdemir's lawyer, Ayşegül İnal, argued that the incident was not a complication and said, "In malpractice cases, it is usually evaluated whether the result is a complication or not. However, there is no complication here. My client's leg, which had no complaints, was operated on. We filed a criminal complaint against the relevant parties. At the same time, we filed a lawsuit for material and moral damages. The process continues."
